Legal Actions Seek to Preserve Election Data and Challenge Voting Machine Use in Response to Concerns Over Transparency and Constitutional Violations
Concord, NH – In an ongoing effort to protect election integrity, a Writ of Mandamus and a motion for preliminary injunctive relief have been filed to prevent the New Hampshire Secretary of State from erasing electronic election data and memory cards used during elections. Current practices allow the Secretary of State’s office to delete this data within approximately five days post-election, sparking concerns over transparency and accountability in vote tracking and recount processes.
The recent filings call for immediate judicial intervention to preserve this critical electronic election data, emphasizing that data erasure severely restricts the ability to verify election outcomes accurately. The injunction aims to ensure all electronic data remains accessible and transparent to protect public confidence in New Hampshire’s election processes.
Simultaneously, New Hampshire election integrity advocate Daniel Richard has filed an ex parte motion for injunctive relief with the New Hampshire Supreme Court, seeking to prohibit the use of voting machines statewide. Richard, who has vocally challenged the constitutionality of voting machines in New Hampshire’s elections, bases his motion on constitutional violations tied to machine voting. His motion aims to restore compliance with election safeguards and further asserts that voting machines undermine the transparency required by state and federal law.
“We are committed to protecting every New Hampshire resident’s right to a transparent and verifiable election,” Richard stated. “The rapid erasure of election data and unverified machine voting should not compromise the democratic process.”
All of Richard’s legal filings, including the ex parte motion and prior case documents, are available on his website, providing the public with open access to all documentation surrounding these critical efforts.
